These Terms and Conditions ("Terms") govern your use of cresdatait.com (the "Website") and, unless a signed agreement says otherwise, the services provided by Cresdata IT ("we", "us", "our"). By using the Website or engaging our services, you agree to these Terms.
1. Use of the Website
- You may use the Website for lawful purposes only.
- You must not try to gain unauthorised access to the Website, its server or any connected system, or interfere with how it works.
- You must not copy, scrape or republish Website content for commercial purposes without our written permission.
2. Information on the Website
Website content is for general information. It describes our services but is not an offer capable of acceptance. Scope, pricing and timelines are only binding once set out in a written quotation or agreement.
3. Quotations and engagements
- Quotations are valid for 30 days unless stated otherwise.
- Work starts once you accept a quotation in writing (including by email) and pay any agreed advance.
- Changes to the agreed scope are quoted separately and need your approval before we carry them out.
4. Fees and payment
- Fees are in UAE Dirhams (AED) and exclude VAT unless stated otherwise. VAT is charged at the applicable rate.
- Invoices are payable within the period stated on the invoice. We may suspend services for overdue accounts after giving notice.
- Recurring services (such as colocation, housing, hosting, support or social media management) are billed in advance for each billing period.
5. Your responsibilities
- Give us accurate information, timely access to premises and systems, and the approvals we need to deliver the work.
- Make sure you have the rights to any content, software, data or trademarks you give us.
- Keep the passwords and credentials we hand over to you secure.
6. Colocation and systems housing
Where we house your equipment, you remain its owner and are responsible for its lawful use, licensing and insurance. Access to the facility follows our security procedures. Service levels such as power, cooling and connectivity are those set out in the relevant service agreement.
7. Third-party products and platforms
Hardware, software licences, cloud services and social media platforms supplied by third parties are subject to their own terms and warranties. We are not responsible for changes, outages or policy decisions made by those third parties, including social media platform rules and advertising approvals.
8. Intellectual property
All Website content, including text, design, graphics and logos, belongs to Cresdata IT or its licensors. Once you have paid in full, you own the deliverables created specifically for you, as the relevant agreement sets out. We keep ownership of our pre-existing tools, code libraries and know-how, and grant you a licence to use them as part of the deliverables.
9. Confidentiality
Each party will keep the other's confidential information confidential and use it only for the purposes of the engagement.
10. Warranties and limitation of liability
- We will perform services with reasonable skill and care, in line with good industry practice.
- Marketing and social media results (such as reach, followers, leads or sales) depend on factors outside our control and are not guaranteed.
- To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data, and our total liability for any engagement is limited to the fees paid for that engagement in the 12 months before the claim.
11. Termination
Either party may end an engagement as the relevant agreement allows. Fees for work already performed remain payable. On termination we will return your data and equipment in a reasonable, agreed manner.
12. Governing law
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute.
13. Changes
We may update these Terms from time to time. The version published on this page applies from its "Last updated" date.
